2. Purposes of data processing, legal bases and recipients

We process personal data insofar as this is necessary for the establishment and fulfillment of contracts and for the implementation of pre-contractual measures (Article 6 (1b) DSGVO, 11-15a TMG) ​​or consent (Article 6 (1a), (7) DSGVO; § 13 Abs. 2 TMG) ​​is present in the respective processing. Processing under contracts and pre-contractual measures

Within the framework of contracts and pre-contractual measures we process so-called inventory and usage data. Inventory data are data that are necessary for the establishment, content, modification or termination (§§ 14 Abs. 1 TMG). Usage data are processed in the provision of a telemedia service in order to enable, execute and settle it (section 15 (1) TMG). If we have concluded agreements with third parties regarding the collection of fees, we will provide them with the inventory and traffic data required for the preparation of the invoice and collection of the charges, whereby the third parties are obliged to observe the secrecy of telecommunications and data protection (Art. 6 (1b) , f DSGVO, § 97 para 1 sentence 3, 4 TKG, § 15 para 5 TMG).

Assertion, exercise, defense of legal claims

For the assertion, exercise and defense of legal claims, we transfer personal data to collection service providers within the meaning of Section 2 (2) sentence 1 of the Legal Services Act (RDG) or lawyers (Article 6 (1b), (f) (4), Section 24 (1) Section 2 BDSG [new]).

3. Duration of data storage

Inventory and usage data are deleted in accordance with § 13 Abs. 4 TMG basically with expiration of the access or the other use immediately after their termination. In addition, usage data are used beyond the end of the usage process, insofar as this is necessary for the purposes of billing (§ 15 (4) TMG).

Copies of official identity documents shall be deleted immediately after the purpose of identification of the relevant participant has been reached (§ 20 (4) of the Personal Identity Cards Act).

Moreover, personal data are generally deleted immediately after the purpose for their processing has been completed (Article 17 (1a) DSGVO).

Insofar as we are contractually or legally obliged to keep for a longer period of time (eg due to tax or commercial regulations for the storage of documents), the data will not be deleted, but restricted in accordance with Art. 18 para. 1c DSGVO for any other processing (Art. 17 para. 3b, e DSGVO, § 35 BDSG, § 15 (4) sentence 2 TMG).

4. Affected rights

Each data subject has the right to information under Article 15 GDPR, the right of correction under Article 16 GDPR, the right to cancellation under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR and the law Data transferability according to Art. 20 DSGVO with regard to the personal data processed by us.
